 MAR Endorses New Arbitration Service Provider

As you may recall, as of July 1st, 2009, Construction Arbitration Services is no longer the preferred arbitration service provider of the Michigan Association of REALTORS®. The MAR now endorses the National Center for Dispute Settlement (NCDS) for arbitration services. Please be aware that the Buy/Sell purchase agreement form has been updated to reflect the recent change in the MAR’s endorsed arbitration service provider. Certain Buy/Sell purchase agreement forms are still in use that list AAA as the endorsed provider. This is no longer the case. The appropriate Buy/Sell purchase agreement forms can be purchased by calling MAR at (517) 372-8890 or online at http://www.zipform.com/. The contact information for the NATIONAL CENTER FOR DISPUTE SETTLEMENT is (586)-226-2470 .

Homebuyer/Home seller Arbitration Language Shortened
The language recommended for purchase agreements regarding the Construction Arbitration Services Buyer Seller Dispute Resolution process is now shorter. The MAR Forms A and I will feature the new language at the next reprinting.

(__) Any claim of Seller or Buyer arising out of this agreement relating to the disposition of the earnest money deposit or the physical condition of the property covered by this agreement shall be arbitrated in accordance with the rules, then in effect, adopted by Construction Arbitration Services. This is a voluntary agreement between the Buyer and Seller and the failure to agree to arbitrate does not affect the validity of this agreement. This agreement is made subject to and incorporates the provisions of Michigan law governing arbitrations. This provision shall survive closing.
